Kids Party Wheels Ltd Booking Terms and Conditions

1. Contract terms 

1.1. We agree to provide our services to you on the following terms and conditions. These constitute a contract. Any other terms and conditions contained in any other document are excluded unless their inclusion is expressly agreed in writing. 

1.2. In these terms and conditions: The ‘services’ means the hire for the time and date agreed with you of your chosen package theme which includes the vehicles and equipment agreed at the time of booking. 

1.3 The person booking the service must be 18 years of age or over, as a booking constitutes as a legally binding contract between you and Kids Party Wheels Ltd.   

2. Payment 

2.1.  In addition to the package price, we require a £100 damage and booking deposit which will be refunded providing that your event took place as planned and no damage or loss has occurred during the hire of our vehicles or equipment. Charge for the ‘services’ is in advance of booking. The balance to be paid 48 hours before the day of the hire. Payment can be made by online bank payment. Your damage deposit will be refunded by online bank payment to your account, up to 48 hours after your event, provided that no damage or loss has occurred.  

3. Your obligations. You agree that you will

3.1. No food, drink or water to be used on or near the vehicles and equipment. 

3.2 Should your event be held outdoors, and it starts to rain, you must cover all vehicles and equipment with the covers provided by us. Should the forecast be continuous heavy downpours then we advise you either have a marquee for your garden or an alternative venue. It is down to you, the hirer, to consider the weather when booking. Should you not have arranged any alternative provisions for bad weather, we are not liable to refund the cost of your party but will hold this in credit for you to rearrange the event.

3.3 The vehicles will be delivered fully charged and should last on average for 2 hours. Should the battery run out, please do not attempt to charge them yourself. 

3.4 Children should be supervised by a responsible adult at ALL times and children MUST be seated in the vehicles whilst using them. 

3.5 Persons over the age of 7 are NOT permitted to use the vehicles.  

4. Cancellation 

4.1. Should the event be cancelled by you prior to the date of your event, the £100 Booking Deposit will be retained and any monies paid over and above the deposit will be refunded. Should you cancel your event within 14 days to the date of the event, all funds paid will be retained.  

4.2 Kids Party Wheels Ltd reserve the right to alter or cancel any event booking on the day due to weather conditions or any other factors outside of our control. In the event of an unforeseen circumstance (such as adverse weather), Kids Party Wheels will do their very best to accommodate this circumstance and continue with the hire, but this may not always be possible. If the event is cancelled due to inclement weather and no other provision has been pre-arranged by the hirer, the deposit is retained, and the event can be re-booked for a later date. If the event is not re-booked then the booking deposit will be retained but the remainder of any monies will be refunded. No other compensation would be given.  

4.3 Kids Party Wheels Ltd reserve the right to deny delivery of a party if the venue or access to the venue is deemed to be unsuitable or unsafe for our staff, upon arrival. No refund will be given in this instance. Venue and access requirements are detailed and agreed to by the customer upon booking.

5. Termination 

5.1 Either we or you shall be entitled to terminate this agreement immediately, by written notice to the other if the other commits any material breach of this agreement and in the case of a breach capable of remedy, fails to remedy it within 7 days after receipt of a written notice, giving full details of the breach and requiring it to be remedied.  

6. Liability 

6.1. We warrant to you that we will seek to supply the services with reasonable skill and care. We accept liability for our own negligence, but only to the extent stated in this clause. 

6.2. Nothing in this agreement shall be constructed as restricting or excluding our liability for death or personal injury resulting from our negligence or for fraud or, to the extent that such rights may not be contracted out of, as affecting the statutory rights of any person dealing as a consumer. 

6.3. For the avoidance of doubt, in no event, shall either party be liable to the other for any indirect or consequential loss of any nature and howsoever caused. 

6.4. We do not have any implied obligation, duty or liability in the contract other than those explicitly stated in this agreement.  

7. Force Majeure 

We are not liable for any breach of this agreement caused by matters beyond our reasonable control, including, but not limited to, acts of God, fire, lightning, explosion, war, flood, disorder, industrial disputes (whether or not involving our employees), failures or interruptions of electricity supplies, weather or exceptional severity or acts of local or central government or other authorities.  

8. General

8.1. No waiver or any amendment to these terms shall be effective unless in writing and signed by both you and us. 

8.2. A person who is not a party to these terms may not enforce any of them under the Contracts (Rights of the third parties) Act 1999. 

8.3. Kids Party Wheels hire the vehicles and equipment on the basis that parental supervision is required at all times, with responsibility resting with the parents for the safety of the children throughout the hire of our vehicles and equipment. 

8.4. At the start of the party the lead hirer is given full instructions on how to drive the vehicles and a full safety briefing.   

Disclaimer; You accept responsibility for your own actions and the participant(s) actions and or involvement. You declare that you are the parent or guardian of any children in the group, or, if not, that you have the authority from the child(ren)s parent(s) or guardian(s) to confirm consent on their behalf. By booking an event you confirm that you have read, agreed and understood these Terms & Conditions.
